Maintain Filings

Did a property search uncover an old permit—or something on the property that does not match the records? You may be told to file to “maintain” the work. Baca Williamson Architects, PLLC helps you understand what the town or village is asking for, document the condition and prepare the drawings needed to move forward.

The name can vary. One Building Department may call it a maintain application; another may treat it as a replacement permit, amendment or legalization. We confirm the right filing for your property before preparing the package.

When a maintain filing may arise

  • An existing addition, dormer, deck, shed, pool or interior alteration needs to be reflected in the record
  • Completed construction differs from previously approved drawings
  • An older permit must be replaced, renewed or completed
  • A sale, refinancing or new permit application uncovers an unresolved condition
  • The Building Department requests drawings of work that already exists

Is “maintain” the same as legalization?

People often use the terms interchangeably, but a Building Department may not. Legalization usually involves completed work that never received the required approval. A maintain or amendment filing can also involve an old permit or changes from approved plans. The town or village makes the final classification.

Does an existing condition automatically qualify?

No. Existing work may still need to comply with applicable zoning and code requirements or receive separate relief. Physical changes, additional documentation or removal may be necessary.

Can this affect another project?

Yes. Unresolved permits or undocumented conditions may delay a new permit or final certificate. Reviewing the property record early can help define the full scope before design or construction proceeds.
